Terms of Service

1. Who we are

LinkBrain is a bookmark management service based in South Africa. When we say “LinkBrain,” “we,” or “us,” we mean the service and its team. When we say “you” or “user,” we mean you — the person using LinkBrain. You can reach us at hello@linkbrain.co.

By creating an account or using the service, you agree to these terms. If you don't agree, please don't use LinkBrain.

2. What LinkBrain does

LinkBrain is a web-based SaaS that helps you save, organize, and search your bookmarks. We store your saved links and associated metadata, and use AI to power features like natural language search, content summaries, automatic tagging, and conversational search (“AI Search”).

We also offer a browser extension, public brain sharing, and import/export tools. Features may evolve over time — we'll notify you of significant changes.

3. Your account

You need an account to use LinkBrain. You're responsible for keeping your login credentials secure and for all activity under your account. One account per person — don't share accounts or create multiple accounts to bypass limits.

You must be at least 16 years old to use the service. You must provide accurate information when creating your account. If we find that account information is false or misleading, we may suspend or terminate the account.

4. Your data, your ownership

You own your data. Your bookmarks, tags, collections, notes, and any content you save belong to you. We store and process this data solely to provide the service (search, summaries, knowledge graph, AI features), but we don't sell your data or use it for advertising. Ever.

You can export your data at any time from your account settings in standard formats (HTML, CSV, JSON). If you delete your account, we will delete your data within 30 days, except where we're legally required to retain it.

By using LinkBrain, you grant us a limited license to process your content as needed to provide the service — for example, generating embeddings for search, creating summaries, and displaying your links back to you. This license ends when you delete your data or account.

5. Intellectual property

LinkBrain's software, design, branding, and documentation are owned by us and protected by copyright and other laws. You may not copy, modify, distribute, or reverse-engineer any part of the service without written permission.

You retain all rights to content you create and save to LinkBrain. We don't claim ownership of your bookmarks, notes, or any user-generated content.

6. Acceptable use

Use LinkBrain for its intended purpose — saving and organizing links. Don't:

  • Store or share illegal, harmful, or abusive content
  • Use the service to spam, phish, or distribute malware
  • Attempt to reverse-engineer, scrape, or overload our systems
  • Access other users' accounts or data without authorization
  • Use automated tools to bulk-create accounts or abuse rate limits
  • Resell or redistribute the service without permission

We reserve the right to suspend or terminate accounts that violate these guidelines, with or without notice depending on severity.

7. Payments & billing

Paid plans are billed through Lemon Squeezy, which acts as our merchant of record. By subscribing to a paid plan, you also agree to Lemon Squeezy's terms of service.

Prices are listed on our pricing page and are billed monthly or annually depending on your chosen plan. We may change prices with at least 30 days' notice. Price changes won't affect your current billing period.

Payments are processed in USD. Your bank may apply currency conversion fees. Failed payments may result in service interruption after a grace period.

8. Cancellation & refunds

You can cancel your subscription at any time from your account settings — no hoops, no questions asked. When you cancel, you keep Pro access until the end of your current billing period. After that, your account reverts to the free tier. Your links are never deleted.

For refunds, please see our refund policy. Refund requests are handled through Lemon Squeezy and are generally processed within 5–10 business days.

9. Service availability

We strive for high availability but don't guarantee 100% uptime. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We'll do our best to notify you of planned downtime in advance. We are not liable for any loss or damage resulting from service interruptions.

10. Privacy

Your privacy matters to us. Please read our Privacy Policy for full details on how we collect, use, and protect your data. Key points:

  • We don't sell your personal information
  • We don't show ads
  • Your links are private by default
  • We use AI to process your content for features, not for training models
  • You can export or delete your data at any time

11. Limitation of liability

LinkBrain is provided “as is” and “as available.” We do our best to keep the service reliable and your data safe, but we can't guarantee that nothing will ever go wrong.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities. Our total liability for any claim is limited to the amount you've paid us in the 12 months prior to the claim, or R500 (ZAR), whichever is greater.

12. Termination

You can delete your account at any time. We may also suspend or terminate your account if you violate these terms, if required by law, or if we discontinue the service.

If we terminate your account without cause, we'll give you reasonable notice and an opportunity to export your data. If terminated for a terms violation, we may terminate immediately. Upon termination, your right to use the service ends, but these terms survive where applicable (e.g., liability limitations, data ownership).

13. Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll notify you via email or in-app notification at least 30 days before they take effect. Continued use of the service after changes means you accept the new terms.

14. Governing law

These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA) where applicable. Any disputes will be resolved in South African courts.
